Benjamin D. Dell is a Partner at Dell & Dean, PLLC, where he represents seriously injured people and their families throughout New York. He has recovered tens of millions of dollars for the firm’s clients through verdicts, settlements, and arbitration awards. He approaches every case with the same conviction: an injured person deserves an advocate who prepares for trial from day one and will not accept less than full, fair compensation.
His practice focuses on complex civil litigation, including medical malpractice, construction site accidents under New York Labor Law §§ 200, 240(1), and 241(6), product liability, motor vehicle accidents, and premises liability. He also handles assault, general negligence, and defective equipment claims. His clients include construction workers injured in falls and on unsafe job sites, patients harmed by medical negligence, victims of car and truck crashes, and people hurt by dangerous products or property conditions. In each case, he takes on well-funded insurance carriers, hospital systems, contractors, and corporate defendants, and he holds them accountable for the harm they cause.
Mr. Dell manages his cases from the first client meeting through final resolution. He investigates liability, builds the medical record, takes and defends depositions, and handles motion practice, mediation, arbitration, and trial. He works closely with medical experts, engineers, economists, and life care planners to document every present and future loss his clients face, from medical expenses and lost earnings to pain and suffering. Just as important to him is the way his clients experience the process. He knows a serious injury upends a family’s life, so he makes himself available, including evenings, weekends, and holidays, and makes sure every client understands where their case stands and feels supported along the way.
His commitment to injured people began long before he became a lawyer. He is the second generation at Dell & Dean, founded by his father, Joseph G. Dell. As a child, he spent his summers at his father’s office instead of at camp, watching the firm’s attorneys fight for their clients. He joined the firm as a legal intern in 2011, working alongside its paralegals, clerks, and staff on every part of its daily operations. From 2016 to 2019, he worked as a deposition analyst, reviewing sworn testimony about medical and surgical care. That experience gave him a command of the medical issues at the center of catastrophic injury and malpractice cases, and it still shapes how he prepares every case.
Mr. Dell earned his Juris Doctor on a merit scholarship from Touro University Jacob D. Fuchsberg Law Center. There, he served as a judicial extern in the United States District Court for the Eastern District of New York, where he studied oral advocacy and judicial decision-making up close, and he interned at the Suffolk County District Court. He was President of Phi Alpha Delta and Director of the Community Advocacy Outreach Program for the Trial Advocacy and Practice Society. He was also selected for the Society’s trial team and competed in the American Association for Justice Student Trial Advocacy Competition in Kings County Supreme Court. He was honored for his contributions to the Society and received the school’s Pro Bono Service Award. He holds a Bachelor of Arts in Political Science from the University of Rhode Island. After his admission to the New York State Bar in 2019, he became a trial attorney with the firm.
His work has earned recognition from his peers. Mr. Dell has been named a Super Lawyers Rising Star, an honor limited to a small percentage of attorneys under 40 or in practice for fewer than ten years, and has been recognized by Marquis Who’s Who for excellence in law. He is an active member of the New York State Trial Lawyers Association, the Nassau Trial Lawyers Association, and the Suffolk Trial Lawyers Association. He is also a member of the New York State Bar Association, the Nassau County Bar Association, and the Suffolk County Bar Association.
Outside the courtroom, Mr. Dell has given more than 150 pro bono hours to help United States veterans obtain the benefits they earned through their service. He does this work in honor of his late grandfather, a U.S. Army veteran who served during the Vietnam Era from 1960 to 1963. Since 2015, he has also volunteered as an organizer for Habitat for Humanity and for the American Cancer Society’s Relay for Life.
Mr. Dell is a relentless advocate for the firm’s clients, and he believes that success, in the courtroom and in practice, begins with humility.
